EXECUTIVE FINDING
Publication records identify a document family; a defensible review still needs the exact file and version.
The European Commission's Public Buyers Community page identifies an updated EU AI model-clause package with separate English downloads for a High Risk model-clause document, a Light Version model-clause document, and a Commentary. It gives a publication date of 5 March 2025 and describes the Light version as customizable for non-high-risk AI. The package page therefore supports identification of distinct source types and their public release context. It does not, by itself, establish which clauses were adopted in a buyer's contract or how they were used.
For the Australian Commonwealth materials, the Australian Government Solicitor's Legal Update No. 327 states that the Commonwealth published AI model clauses on 17 March 2025, describes their procurement use cases, and points readers to BuyICT. The update also says the clauses do not form a complete contractual arrangement and require selection and tailoring. The archived source record used for this demonstration identifies the primary document as DTA Artificial Intelligence (AI) Model Clauses, Version 2.0, metadata Version 1801. This is a version identifier for the archived file; it should travel with that file in later analysis.
Practical result: cite the exact document and version used, preserve the official source route and retrieval date, and keep commentary or explanatory guidance separate from operative model-clause text.
SOURCE INVENTORY
| Record | What the public record establishes | How it is treated here |
|---|---|---|
| EU updated model-clause resource page, Public Buyers Community | Page publication date: 5 March 2025. It lists English downloads for High Risk clauses (DOCX), Light Version clauses (DOCX), and Commentary (PDF). | Primary release-page evidence for the package contents and publication metadata. The Commentary is contextual guidance, not treated as an operative clause document. |
| Australian Government Solicitor, Legal Update No. 327 | Published 4 April 2025; states the Commonwealth AI model clauses were published 17 March 2025 and directs readers to BuyICT. | Official explanatory record that corroborates release context and identifies the hosting route. It is not substituted for the clause document itself. |
| DTA Artificial Intelligence (AI) Model Clauses, Version 2.0 / metadata Version 1801 | The preserved project source register identifies the archived primary file and its BuyICT retrieval route, recorded 11 September 2026. | Use the archived file and exact version label when examining clause text. Recheck the current official route before relying on a later version. |
DOCUMENTARY OBSERVATIONS
One page can list documents with different evidentiary roles.
The EU release page places two model-clause DOCX files and a Commentary PDF within one package. The page itself distinguishes the Commentary as guidance about use, customization, and application. Treating every package file as an operative clause would blur a material source boundary.
Publication date and document version answer different questions.
The EU page supplies a package publication date. The Australian archived source has its own version and metadata-version labels. Neither type of label should be silently converted into the other: a release-page date does not uniquely identify a downloaded file, and a file version does not establish when a later copy was retrieved.
The Australian explanatory source describes intended use and tailoring.
AGS describes the clauses as a resource for specified procurement situations and says buyers must select and tailor clauses for their contract. This supports a cautious description of the documents as model clauses. It does not show that a particular buyer incorporated them.
The source route is part of the evidence trail.
The EU resource page and BuyICT route point readers toward official material. For repeatable analysis, retain the downloaded file, source URL, retrieval date, file version or date marking, and a stable locator for every proposition used.
RECOMMENDED SOURCE-REGISTER FIELDS
- Issuing organization and exact document title.
- Document type: operative model text, commentary, explanatory note, or contextual policy.
- Printed version, metadata version, publication date, and retrieval date, each in its own field.
- Official publication URL plus a preserved copy of the reviewed file.
- Page, section, clause, article, or other locator attached to each extracted claim.
- Any known nesting or dependency between document variants.
LIMITS AND NON-CLAIMS
This demonstration reviews public-facing source records and a project archive record. It does not assess the substantive sufficiency, legal effect, adoption, negotiation, enforceability, compliance, or performance of any clause. It makes no comparison ranking Australia and the EU. The publicly available package pages can change, and a current user should verify the linked source and exact file before relying on it.
The demonstration is independent work prepared by Mami to show documentary research and report structure. It is not a commissioned engagement, client case, endorsement, or validated audit.
